Issues of waiver, estoppel, and bad faith need to be understood not just as hazards but from the perspective of transparency and fair play. On top of this mixture there are issues of state statutory law, case law, insurance department regulations, and various interpretation of each by friend and adversary alike. This makes for an interesting and challenging environment for the adjuster in the field.
